• "Contract" refers to the agreement between us and the Customer for the sale of a vehicle or provision of services.
• "Vehicle" refers to any automobile, whether new or used, offered for sale by us.
• "User" refers to any person accessing or using our Website.
• "Content" refers to all information, text, images, data, links, software, or other material that we display or make available through the Website.
License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Website for personal, non-commercial purposes in accordance with these Terms.
Prohibited Activities: You agree not to:
• Use the Website in any way that violates any applicable local, state, national, or international law or regulation.
• Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Website.

Pricing and Payment: All prices listed on our Website are in Indian Rupees (INR) and are subject to change without notice. Prices do not include registration, taxes, insurance, and other applicable fees unless explicitly stated. Payment terms will be as specified in the purchase agreement.
Booking and Deposits: When you book a vehicle with us, a booking amount may be required. This amount is subject to our refund policy as detailed in section 5 below.
Delivery: Delivery timeframes are estimates only and may vary depending on various factors including but not limited to manufacturer availability, customization requirements, and regulatory clearances.
Title and Risk: Title to the vehicle passes to the Customer upon full payment and completion of all required documentation. Risk of loss or damage passes to the Customer upon physical delivery of the vehicle.
Booking Cancellations: If you cancel a vehicle booking:
• Before the vehicle is allocated or ordered from the manufacturer: Full refund of the booking amount, less administrative charges of 2% or ₹2,000, whichever is lower.
• After the vehicle is allocated or ordered from the manufacturer but before delivery: Refund of the booking amount less 10% or as per the specific vehicle's booking terms.
• After vehicle delivery: No refund of the booking amount.
Service Cancellations: For service appointments:
• Cancellation more than 24 hours before the scheduled appointment: Full refund of any advance payment.
• Cancellation less than 24 hours before the scheduled appointment: 50% of any advance payment will be forfeited.
Processing Time: All refunds will be processed within 10-15 business days and will be made using the original payment method.
New Vehicles: New vehicles come with the manufacturer's warranty. The terms and conditions of such warranty are as specified by the manufacturer and are available upon request.
Used Vehicles: Used vehicles may be sold with a limited warranty, the terms of which will be specified in the purchase agreement. Some used vehicles may be sold "as is" with no warranty.
Service Warranty: Our service work is warranted for a period of 3 months or 3,000 kilometers, whichever occurs first, from the date of service completion. This warranty covers defects in workmanship but does not cover normal wear and tear.
Disclaimer: EXCEPT AS EXPRESSLY PROVIDED HEREIN, ALL VEHICLES AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Eligibility: Test drives are available to individuals who are at least 18 years of age and possess a valid Indian driving license for the vehicle category being tested.
Requirements: We may require you to provide a copy of your driving license and other identification documents before a test drive. This information will be processed in accordance with our Privacy Policy.
Responsibilities: During a test drive, you are responsible for:
• Driving safely and in accordance with all applicable traffic laws and regulations.
• Not driving under the influence of alcohol, drugs, or any other substance that may impair your ability to drive.
• Any traffic violations, fines, or penalties incurred during the test drive.
• Any damage caused to the vehicle due to negligence or misuse.
Appointments: Service and maintenance work is performed by appointment only. We will make reasonable efforts to accommodate your preferred date and time, but availability is not guaranteed.
Estimates: We provide estimates for service and repair work based on our assessment of the vehicle. However, additional charges may apply if additional issues are discovered during the service process. We will seek your approval before performing any additional work that would significantly increase the estimated cost.
Parts: We use genuine or manufacturer-approved parts for all service and repair work unless otherwise requested by the Customer.
Vehicle Collection: Vehicles must be collected within 3 days of service completion. Storage charges may apply for vehicles not collected within this timeframe.
Ownership: The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof), are owned by New My Choice Cars Pune, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Use Limitations: You may access, view, and use the content on our Website for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Website.

Liability Cap: To the extent liability cannot be excluded, our maximum liability to you for all damages arising out of or related to these Terms or your use of our Services will not exceed the greater of: (i) the amount paid by you to us for the Service at issue in the past 12 months; or (ii) INR 10,000.
Exceptions: The limitations of liability set out above do not apply to liability resulting from our gross negligence or willful misconduct, or for death or personal injury caused by our negligence or willful misconduct.
You agree to defend, indemnify, and hold harmless New My Choice Cars Pune, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Website or Services, including, but not limited to, any use of the Website's content, services, and products other than as expressly authorized in these Terms.
These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Website shall be instituted exclusively in the courts of Pune, Maharashtra, India. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Informal Resolution: In the event of any dispute, claim, question, or disagreement arising from or relating to these Terms or the breach thereof, you and New My Choice Cars Pune shall use best efforts to settle the dispute, claim, question, or disagreement. To this effect, you and New My Choice Cars Pune shall consult and negotiate with each other in good faith and, recognizing mutual interests, attempt to reach a just and equitable solution satisfactory to both parties.
Formal Resolution: If you and New My Choice Cars Pune do not reach such solution within a period of 30 days, then, upon notice by either party to the other, all disputes, claims, questions, or differences shall be finally settled by arbitration in Pune, Maharashtra, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a single arbitrator mutually appointed by the parties.
We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter.
Your continued use of the Website following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.
If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.
These Terms, our Privacy Policy, and any purchase agreement constitute the sole and entire agreement between you and New My Choice Cars Pune regarding the Website and Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Website and Services.
